These Terms and Conditions ("Terms") govern your access to and use of the Luny website (https://luny.com.au), our applications, our rewards program, our prize competitions and related services (together, the "Service"). By accessing or using the Service, or by entering any competition we run, you agree to be bound by these Terms. If you do not agree, please do not use the Service. Please also read our Privacy Policy and Refund Policy.
1. About us
The Service is operated by Luny ("we", "our", "us"), based in Australia. You can contact us at any time through our contact page.
2. Eligibility
To create an account or enter a competition you must be at least 18 years of age and a resident of Australia. We may ask you to verify your identity, age or residency at any time, and we may withhold a prize until that verification is complete.
3. Your account
You are responsible for keeping your account details and password secure, and for all activity that occurs under your account. Please tell us promptly if you believe your account has been used without your permission. You must give accurate information and keep it up to date, because we use it to contact you about entries and prizes.
4. Entries
Entries are allocated once your payment has been successfully processed. The number of entries included in each package is shown at the point of purchase. Entries apply only to the competition that is open at the time of purchase, cannot be transferred to another competition, and have no cash value.
Each competition has its own closing time, shown on the competition page. Entries received after that time are not included in the draw.
5. Prizes and draws
The prize for each competition is described on the relevant competition page. The winner is selected from all valid entries for that competition. We contact the winner using the details held on their account, so please keep them current.
Where a prize is offered with an alternative (for example, a vehicle or a cash amount), the winner may choose between the options presented at the time of the draw. Prizes are not transferable unless we agree in writing.
6. Payments
All prices are shown in Australian dollars (AUD) and include any processing fee, which is displayed before you confirm payment. Payments are handled by our payment providers; we do not store your full card details.
7. Memberships and recurring payments
If you buy a membership, it renews automatically at the interval shown at checkout until you cancel. You can cancel at any time from your account, and cancelling stops future payments. See our Refund Policy for how cancellations and refunds are handled.
8. Acceptable use
You agree not to interfere with the Service, attempt to gain unauthorised access to it, use automated systems to create accounts or entries, or use the Service for any unlawful purpose. We may suspend or close an account, and cancel the entries associated with it, where we reasonably believe these Terms have been breached.
9. Availability
We aim to keep the Service available at all times but cannot guarantee uninterrupted access. We may change, suspend or withdraw parts of the Service, and will give notice where it is reasonable to do so.
10. Our liability
Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot be excluded. Subject to that, our liability to you is limited to resupplying the relevant service or paying the cost of having it resupplied.
11. Changes to these Terms
We may update these Terms from time to time. The effective date above shows when they were last changed. Where changes are significant we will take reasonable steps to notify you. Continuing to use the Service after a change means you accept the updated Terms.
12. Governing law
These Terms are governed by the laws of Australia, and you and we submit to the non-exclusive jurisdiction of its courts.
