Welcome to the Luny website (we, us, our, or Luny).
Access to and use of our website at https://luny.com.au, and social media channels (together our Website) and membership to our reward program (our Service), is conditional upon your agreement to, acceptance of and compliance with these terms and conditions (Terms). These Terms apply to the entire Website and any email, SMS or other type of communication between you and Luny. If you have any concerns about these Terms, you should not access or use our Website or Service.
By accessing or using the Website, registering an account, or participating in our rewards program, you confirm that you agree to be bound by these Terms.
We may change the Terms at any time at our discretion. You will be notified of any change and where we believe that such change is a material change to the way we provide our Service, that notice will be provided at least 30 days in advance. A copy of the revised Terms will also be available on the Website. Your continued use of or participation in our Service, or receipt of any reward after this notice is provided will be deemed to be acceptance of the revised Terms. If you do not wish to accept the revised Terms you may request to close your account, please email us support@luny.com.au when logged in to your Luny account.
For the purposes of these Terms:
- Cookie means a small piece of data stored on your device by your web browser used to identify your browser and assist with functionality and analytics.
- Device means any internet connected device such as a phone, tablet, computer or similar device used to access the Website.
- Third-party services means advertisers, retailers, marketing partners or other service providers that may provide content or services through the Website.
- Website means the Luny website accessible via https://luny.com.au.
- Service means the rewards platform and related services provided by Luny through the Website.
- You means the individual or entity accessing the Website or using the Service.
1. About our Service
1.1. Luny is a shopping platform where you earn cash rewards from retailers into your Luny account, either by shopping online or instore at a Luny retailer.
1.2. When you sign up, you need to provide us with accurate information about your Luny account so that we can make payments to the right account.
1.3. When you shop with retailers who have joined our program, you will receive the reward amount set out on the Website for your purchase. So that you can receive the reward, we must be able to track your purchases, which we can only do if you:
- are logged in to Luny and have clicked the retailer's “Shop” button on our Website when you shop online; or
- shop directly from retailer-specific promotional emails we send you.
We may not be able to track your rewards for online or instore purchases if:
- your browser is in incognito mode
- you do not have cookies turned on
- you click the “Shop” button, then close the window and visit the retailer directly
- you use a coupon code not supplied by Luny
- you use a gift card
- you are redirected to a retailer's mobile app
- you shop instore at a non-Luny retailer
- you shop instore at a Luny retailer using a card that is not linked to Luny
1.4. Not all debit and credit cards are eligible to be linked to your Luny account. Eligible cards must generally be issued by an Australian financial institution and processed through Visa or Mastercard payment systems.
Examples of ineligible cards include:
- prepaid cards
- corporate or purchasing cards
- store-only cards
- government administered prepaid cards
- gift cards
1.5. Luny reserves the right not to pay rewards where the purchase was not made in accordance with clause 1.3.
1.6. Rewards earned through the Service will be paid into your nominated PayPal account and cannot be redeemed directly as physical cash through the platform.
1.7. If you have questions about how your Luny account works, you should contact Luny directly.
1.8. If it appears you will earn more than $1,000 of rewards in any single payment cycle, we may contact you to discuss additional payment verification requirements.
2. Our Website and Service do not provide personal advice
2.1. While we use reasonable efforts to ensure the accuracy of information on the Website, any information provided through the Website or Service is general in nature and does not constitute financial or personal advice.
3. Some fine print about how our Service works
3.1. Payments from your Luny account to your PayPal account are typically processed between the 15th and 20th of each month, after Luny receives the reward payment from the retailer.
3.2. Payments may not be processed if you have provided incorrect payment details.
3.3. Some Luny accounts may have a minimum payment threshold (for example $10). Rewards will accumulate until this threshold is reached.
3.4. If you have not provided PayPal payment details, rewards will remain in your Luny account until correct details are provided.
3.5. If we have made repeated attempts to contact you over a period of 12 months and you have not shopped during that time, we may close your account and forfeit your rewards balance. A final notice will be provided at least 30 days prior to closure.
3.6. Luny receives a referral commission from retailers for qualifying purchases. The reward amounts displayed in the Luny dashboard already reflect this commission deduction.
4. Use of the Website and Service
4.1. You must use the Website and Service in accordance with these Terms.
4.2. By using the Website you warrant that you are over 18 years old or have obtained parental or guardian consent.
4.3. You are responsible for all activity conducted through your account.
4.4. You must keep your account login information secure and notify us immediately of any suspected security breach.
4.5. We may restrict, suspend or terminate your access to the Website or Service at our discretion.
4.6. Luny may modify or discontinue the Website or Service at any time.
4.7. The Website may contain links to third-party websites. Luny does not endorse or guarantee the accuracy of third-party content.
5. Registration
5.1. To access the Service you must register as a Luny Member.
5.2. Membership requires creation of an account through the Website.
5.3. You must provide a valid email address during registration.
5.4. You warrant that all information provided during registration is accurate.
5.5. If your details change, including your PayPal email address, you must update your account details promptly.
5.6. We recommend that you regularly log in to verify that rewards have been correctly credited.
5.7. Luny may discontinue the Website or Service at any time.
5.8. To the extent permitted by law, we will not be liable for discontinuation of the Service.
6. Use of linked debit or credit cards
6.1. By linking a payment card to your Luny account you authorise Luny and its third-party providers to share card information with card networks such as Visa or Mastercard in order to monitor qualifying instore transactions.
6.2. Transaction information may be used to determine eligibility for rewards.
6.3. You may opt out of instore tracking by removing your linked card from your account.
7. Unauthorised or Mistaken Transactions
7.1. Payments made to PayPal accounts are generally irreversible once completed.
7.2. If you suspect fraudulent activity on your account you must contact Luny immediately.
7.3. You should also contact PayPal directly regarding any suspected PayPal account fraud.
8. Prohibited conduct
8.1. You must not:
- use the Website for unlawful purposes
- send unsolicited communications
- interfere with the Website infrastructure
- transmit viruses or harmful code
- reverse engineer the platform
- use the Service for commercial or automated purposes
8.2. If we reasonably believe your use of the Service is excessive or abusive, we may suspend or terminate your access without notice.
9. Intellectual Property
9.1. All content on the Website including text, graphics, software, and design elements are owned by Luny or its licensors and are protected by intellectual property laws.
9.2. You must not copy, reproduce or distribute any content without prior written permission.
9.3. If you submit reviews, feedback, or other content to Luny you grant Luny a perpetual, royalty-free licence to use and distribute that content.
10. Liability
10.1. You indemnify Luny against losses resulting from your breach of these Terms.
10.2. The Website and Service are provided “as is” and “as available”.
10.3. To the extent permitted by law, Luny excludes liability for any indirect or consequential losses including loss of profit or data.
10.4. We do not guarantee that the Website will be uninterrupted or error-free.
10.5. Our services may come with guarantees under the Australian Consumer Law that cannot be excluded.
11. Privacy
11.1. Personal information provided to Luny is handled in accordance with our Privacy Policy.
11.2. The Website uses cookies to enhance functionality and performance. Disabling cookies may limit some features of the Service.
12. Complaints
12.1. If you have a complaint, please contact support@luny.com.au.
12.2. We will attempt to resolve complaints promptly through our complaints handling process.
13. Disputes
13.1. Any dispute relating to these Terms should first be referred for discussion between the parties.
13.2. If the dispute cannot be resolved within 10 business days, it may be referred to mediation through the Australian Disputes Centre.
13.3. Each party will bear its own mediation costs.
14. General
14.1. These Terms are governed by the laws of Victoria, Australia.
14.2. If any provision is found invalid, the remainder of the Terms remain in effect.
14.3. Failure by Luny to enforce any right does not waive that right.
